Ep09 - Skylar Neese

Tonight we are discussing the murder of Skylar Neese, a 16-year-old girl from West Virginia. She went missing in July 2012 and rumors swirled as to what happened to her. Her parents tirelessly searched for her hoping for the best. The community was shocked when remains were found just across the state border in Pennsylvania was found in January 2013. The community suffered another stunning blow when Skylar’s two best friends were arrested for her murder.

This case is interesting because there is a huge social media paper trail.

Ep08 - Luka Maggnota

Thank you, Jill, for sending us this case.  I found this case very intriguing, not only because of his horrendous crime but his dark journey that led him there.  I applaud the Animal Beta Project and the Facebook investigators that worked tirelessly to bring him to justice.

Here is a link to the mini documentary by CBC News.  A lot of good interviews with his ex girlfriend Barbie and the anonymous investigators from the Animal Beta Project.  There is some information on Jun Lin as well.  You can see how he was thriving in his new life, only to have it cut short by Luka.

Ep07 - Jamison Family

Today’s case is the Jamison Family Deaths.  My dear friend Nichole brought this case to our attention and researched it.  She did an amazing job and Colleen and I felt it was fitting that she co-hosts this episode.

As a writer, Nichole adds a flair and charming descriptive nature to this story.

As we talk about in the show, we’ve added a picture (or two!) of Sheriff Israel Beauchamp at the bottom of this post.

There are so many unknowns with this case; below are some of the controversial items discussed in the episode:

The picture of the Madyson; is she in distress?  Or is she just being pithy?  Is this indicative of someone trying to hurt her?

Were the Jamison’s on drugs?  The picture below was pretty recent; are they too thin, showing signs of drug use?  Or are they just slender people?

There is a video of them packing the truck before leaving the day they went missing.  They appear to be not speaking to each other; once we find that link, we will post (very hard to find).  But is not talking while packing mean they were in a drug induced “trance”  or were they just having an argument and not talking to each other?

Ep06 - Evelyn Hernandez

Tonight we are discussing the case of Evelyn Hernandez. She was a 24 year old woman who was due to give birth in a week who was last seen alive on May 1st 2002 with her 5 year old son, Alexis. Her body was found floating along the Embarcadero in the San Francisco Bay on July 24th 2002 and her son has never been found. As of today, the case remains unsolved, although foul play is suspected.

5 months after Evelyn’s body was discovered in, Laci Peterson would go missing in nearby Modesto, California and coverage of the investigation would grip the nation for months. Although these cases are strikingly similar, one received worldwide attention and the other was barely covered locally. Tonight we will be discussing what happened to Evelyn and the disparities in the media coverage between the two cases.

Since not a lot is known about what happened to Evelyn, we’ve included some links for further reading.

Ep05 - Kristen Modafferi

Local cases are always of interest to us; we like to see what goes on in our backyard.  As I researched this case, however, I found it more and more odd and with all cases where people seemingly vanish, I found it very frustrating.

I think John and Jill did have something to do with her disappearance, however.  The call that is noted on the www.FindKristen.com website (click here) was the straw that broke the camels back, so to speak.

Ep04 - Sneha Philip

This case is really frustrating for me due to the lack of evidence; so much of the discussion of this case quickly turns to speculation and assumptions because there is so little to go on.

New York Magazine published an article in 2005 that details what it known about the case and Sneha’s last known whereabouts in the most complete write up I have found through my research. You can read the full article here.

Eileen and I spent most of our time discussing the theories of what could have possibly happened to Sneha. Most of our conversations just ended up in a looping through the main prominent theories, so we tried to rein it in when we recorded so we didn’t get too repetitive.

The piece of evidence I keep coming back to is the woman she was with at Century 21 on September 10th. I can’t imagine why she hasn’t come forward, unless they both died in the attacks on the 11th. But again, it requires quite a bit of speculation to reach that conclusion. It is very strange that she never came forward and was never identified.

I could honestly spend hours nitpicking individual pieces of evidence and speculation. What do you think happened to Sneha on the 10th/11th of September 2001?

Ep03 - Richard Rosario

This case was brought to our attention by my Wife’s co-worker; his wife was one of the pro-bono attorneys working on Richard’s case.  I am a sucker for police/prosecutorial misconduct (hey, that’s the name of our show!) and this one, in my opinion, is up there.  Twenty years gone and lives forever changed. 

I have great respect for the amazing attorneys that took on his case pro-bono and the Bronx DA Darcel Clark who was willing to give this case a thorough review.  Without either, he would most likely still be in jail.

Below is the picture that the NYPD had in “the books” and was used to identify Richard as the shooter.  The last two pictures are A) an image of Richard’s statement in the June 2016 court hearing.  B) Richard and his wife post charges being dismissed.   

Richard and his family’s resilience is inspiring and I hope the best for all of them.

Ep02 - The Grim Sleeper Part 2

This episode we decided to focus more on the legal process and trial. Hopefully you found it as interesting as we did! Eileen and I like to discuss the United States criminal justice system partly because it is what we are most familiar with and partly because so often it doesn’t work the way it is supposed to.

This is the list that was released by the LAPD asking for help identifying over 150 women. Around 30 remain unidentified to this day.

Ep01 - The Grim Sleeper Part 1

Welcome to our first blog post! The Grim Sleeper is a topic we both found interesting, mainly because it is such a complicated case. We use our blog posts to expand on our opinions on various topics and points discussed in the episodes and encourage any questions or comments below!

I actually first heard of the Grim Sleeper when I was searching through Netflix and HBO for something to watch on a rainy day. I ended up coming across Nick Broomfield’s documentary called Tales of the Grim Sleeper and it blew me away that I hadn’t heard about this case before. Eileen and I both highly recommend that documentary for a more in depth look at the area the Grim Sleeper lived, worked, and killed in. I think Nick does a good job of letting the people who knew him tell their stories.                

We felt that going into more detail about the history of South L.A. was an important aspect of our discussion because the history ties so closely with the conditions that allowed the Grim Sleeper to hunt women largely undetected and uninvestigated by law enforcement. The issue of LAPD’s noninvolvement with the case was one of the hardest things to read about when researching this case. It’s hard not to wonder the ‘what if’s’ in a situation like this with a high number of victims over a long period of time. There were so many missed opportunities that could have allowed the Grim Sleeper to be apprehended sooner that slipped through the LAPD’s fingers. During this case Eileen and I just kept coming back to why. Why wasn’t the case investigated properly? Why wasn’t the orange Pinto lead pursued? Why wasn’t Eneitra Washington taken seriously after surviving her attack?

The Southside Slayer could be an episode unto itself. So many details of this case were shocking, but this one might have been the most startling. Five active serial killers in one location killing over a span of decades is (to me, and probably most of you) scary to say the least.

The topic we probably talked about the most was the issue of the familial DNA search. Eileen and I happen to agree on the topic overall, but there was a lot that I learned about DNA and fingerprint collection in California that we ended up spending a lot of time talking about. On one hand I’m glad the Grim Sleeper was apprehended, on the other hand (and we said it several times in the episode) I think the search itself is a slippery slope.

Lastly, I want to leave you with the article written by Christine Pelisek ran by the LA Weekly in 2008 exposing the existence of the Grim Sleeper and the 800 Task Force. It’s a long, fascinating read and really gives an insight on what was known at the time, but more importantly what questions were left terrifyingly unanswered.

Hello and welcome to misconduct.!  misconduct. is available on iTunes and SoundCloud and is hosted by myself and Colleen.  Colleen also happens to be my niece.  Like any good aunt, I made sure she started young watching crime TV like Law and Order and Discovery ID.  It's not an uncommon occurence for Colleen to stay the weekend with me and my wife and binge watch true crime documentaries.
